COURT REJECTS ELECTRICITY BILL




A Federal High Court sitting in Lagos, yesterday, invalidated the adjustment in power levy recently introduced  by the Nigerian Electricity Regulatory Commission, NERC. During the case, Trial judge, Justice Mohammed Idris in his judgment in the suit by a human rights legal advocate, Mr. Toluwani Adebiyi, argued that NERC's activity as procedurally ultra vires, unreasonable, sporadic and illicit. In a quick response, The Nigeria Labour Congress commended the judgment and asked NERC and DISCOs to promptly regard the decision, depicting it as a "triumph for the ordinary Nigerian who had been pounded by exploitative bills."electricity-bill''. These issues are happening on the same  day the House of Representatives portrayed the Distribution Companies, DISCOs, as the greatest trick in Nigeria and told the Federal Government to end any increase in electricity tariff in the nation.

 During the judgement,the court, depending on Sections 31, 32 and 76 of the Electricity Power Sector Reform Act(EPSRA) 2005, in choosing the substantive suit, held that, "NERC acted outside the agreement presented to it by the Act and neglected to take after the recommended procedure."The court said that "NERC has not proved that it acted in due submission to the endorsed methodology and that there is no confirmation that NERC followed Section 76(6)(7)and (9) of the EPSRA Act. Im reaction to this judgement, The Nigerua Labour Congress says the judgment is a "triumph for the Nigerian citizen who has been smashed by exploitative bills." Labor hails the judgement. Speaking through the administrator of Nigeria Labor Congress, NLC, Ayuba Wabba, Labor said: "We, at the Nigeria Labor Congress, wish to express that this is a bold judgment meriting tribute. ''We likewise think of it as triumph for the conventional Nigerian who have been squashed by exploitative bills. We ask NERC and DISCOs to comply with the judgment and return to the old rates immediately. We request that the NERC and DISCOs watch every one of the conditions point of reference as contained in the business assention before any increment is made.''

 Meanwhile, the House of Representatives yesterday said that the Distributions Companies, DISCOs are the greatest trick in Nigeria and approached the Federal Government to stop any arrangement to hike electricity bill by 100% in the nation.
