The National Judicial Council (NJC) has wielded the big stick as it has
recommended the compulsory retirement from office of Justice O.
Gbaja-Biamila of Lagos State High Court and Justice Idris M.J. Evuti of
the Niger State High Court.
Giving reasons for its disciplinary action against the erring judges,
the NJC said in a statement issued by its Acting Director of
Information, Mr Soji Oye, that the council found them wanting after
considering petitions that were written against them.
In the petition that was written against Justice Gbaja-Biamila by Mr.
C.A. Candido Johnson (SAN), it was alleged that the judge delivered
judgment 22 months after written addresses were adopted by all the
Counsel and 35 months after the close of evidence in the Suit, contrary
to the Constitutional Provisions that judgments should be delivered
within a period of 90 days, among other sundry misconducts.
For Justice Evuti along with Justice Tanko Yusuf Usman of the High
Court of Niger State, they were found guilty of age falsification.
The council, however, absolved Justice Saliu Saidu of the Federal High
Court, Lagos of misconduct as it found unsubstantiated, a Petition of
alleged misconduct written against him by Securities and Exchange
Commission.
Consequently, the NJC reported lawyer to the SEC, Oluwaseun Olusiyi to
the Legal Practitioners Disciplinary Committee for walking out on the
Judge on the matter when she was told the matter was not ripe, for
hearing for disciplinary action.
In the statement issued Tuesday, the NJC said: “The National Judicial
Council under the Chairmanship of the Honourable, The Chief Justice of
Nigeria, Hon Justice Mahmud Mohammed, GCON, at its Meeting which was
held on 13th and 14th April, 2016.
